Welcome to Homewear. These Terms of Service ("Terms") apply to your use of the Homewear website and online store and to purchases made through our website.

In these Terms, "Homewear", "we", "us" and "our" refer to Homewear.

Homewear is a sole-trader business operating in England. Our online store is powered by Shopify.

By accessing or using our website, or placing an order with us, you agree to these Terms. Please read them carefully before using our website or placing an order.

These Terms should be read together with our other policies, including our Privacy Policy and Returns & Refunds Policy.

Nothing in these Terms affects or limits any legal rights you have under UK consumer law.

Nothing in these Terms excludes your statutory rights if a product is faulty, not as described, not of satisfactory quality or not fit for purpose.

When you place an order through our website, you are making an offer to purchase the products in your order.

After you place an order, you will normally receive an order confirmation acknowledging that we have received your order.

An order confirmation does not necessarily mean that your order has been accepted. We may need to verify payment, product availability or other order information before accepting the order.

A contract for the purchase of goods will be formed when we accept your order and confirm that the goods have been dispatched or otherwise confirm acceptance, subject to applicable law.

If we are unable to accept an order, we will normally notify you and refund any payment you have made for the affected order.

We may refuse or cancel an order where, for example:

  • a product is unavailable;

  • there is an obvious pricing or product-description error;

  • we reasonably suspect fraudulent or unlawful activity;

  • payment has not been successfully authorised; or

  • we are unable to fulfil the order for reasons outside our reasonable control.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled order.

SECTION 4 - PRICES AND PAYMENT

All prices displayed on our website will be the prices applicable to the products at the time you place your order.

Where applicable, the total price and any applicable taxes, delivery charges or other mandatory charges will be shown before you complete your purchase.

Delivery charges will be shown separately where applicable.

Prices may change from time to time, but a price change will not affect an order that we have already accepted, except where an obvious pricing error applies.

We accept the payment methods made available through our checkout.

By placing an order, you confirm that you are authorised to use the payment method provided.

Payment must be successfully authorised before we can process your order.

SECTION 5 - SHIPPING AND DELIVERY

We deliver orders to the locations shown as available at checkout.

Estimated delivery times are provided on our website or during checkout where applicable.

Delivery times are estimates unless a specific delivery date or period has been expressly agreed with you.

We will keep you informed about significant delivery issues where reasonably possible.

If your order is delayed, this does not remove any legal rights you may have.

We remain responsible for the goods until they come into your physical possession or the possession of a person you have identified to receive them, unless applicable law provides otherwise.

If goods fail to arrive within the agreed period, or within 30 days where no different period has been agreed, you may have rights under applicable consumer law.

Because Homewear uses third-party fulfilment and dropshipping suppliers, your order may be shipped directly from a supplier or fulfilment partner.

Any delivery information provided at checkout will take precedence over general estimates in these Terms.

SECTION 6 - RETURNS, REFUNDS AND CANCELLATIONS

Our Returns & Refunds Policy forms part of these Terms.

We provide a voluntary 20-day returns policy for eligible purchases in addition to your statutory rights.

You may also have a statutory 14-day cancellation right for online purchases, subject to applicable legal exceptions.

Nothing in these Terms or our Returns & Refunds Policy limits or excludes your statutory consumer rights.

Where an item is faulty, damaged, incorrect, not as described or otherwise does not meet applicable legal requirements, you may have rights to a repair, replacement, refund or another remedy depending on the circumstances.

In some circumstances, Homewear may issue a refund without requiring you to return the goods.

SECTION 7 - PRODUCT AVAILABILITY

We try to keep product availability information accurate.

However, products may occasionally become unavailable after an order is placed.

If a product becomes unavailable and we cannot fulfil your order, we will notify you and refund any payment made for the unavailable product where required.

We may discontinue products or change product specifications where permitted by law.

SECTION 8 - THIRD-PARTY SUPPLIERS AND FULFILMENT

Homewear uses third-party suppliers and fulfilment providers to source and deliver products.

This means that some orders may be prepared and shipped directly by a third-party supplier or fulfilment provider rather than from Homewear premises.

Our use of third-party suppliers does not affect your statutory rights against Homewear as the seller.

We remain responsible for our obligations to you under applicable UK consumer law.

SECTION 9 - INTELLECTUAL PROPERTY

Unless otherwise stated, the content on our website, including text, logos, graphics, images, design elements and other materials, is owned by or licensed to Homewear or used with permission.

You may access and use the website for your personal and non-commercial purposes.

Nothing in these Terms transfers ownership of our intellectual property to you.

We are not responsible for the content, availability or privacy practices of third-party websites that we do not control.

SECTION 11 - SHOPIFY

Our online store is powered by Shopify.

Shopify provides the ecommerce platform that allows us to sell products and provide our online store.

Your purchase contract is between you and Homewear, not Shopify.

Shopify is not responsible for the products sold by Homewear or for our obligations to you as the seller.

SECTION 12 - REVIEWS AND CUSTOMER FEEDBACK

If you submit a review, comment, photograph, suggestion or other content to us ("Feedback"), you agree that you have the right to provide that content and that it does not infringe another person's rights.

You must not submit content that is unlawful, fraudulent, defamatory, abusive, obscene, threatening or otherwise inappropriate.

Where you voluntarily provide Feedback, you grant Homewear a non-exclusive, worldwide, royalty-free licence to use, reproduce, display and publish that Feedback for purposes connected with operating, improving and promoting Homewear, subject to applicable law.

We may remove or decline to publish Feedback that we reasonably consider inappropriate, unlawful, misleading or inconsistent with these Terms.

Nothing in this section affects your legal rights or our obligations concerning genuine customer reviews.

SECTION 13 - ERRORS AND CHANGES

We try to ensure that information on our website is accurate.

However, there may occasionally be typographical errors, pricing errors, product-description errors or other inaccuracies.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Subject to the above, we will only be responsible for losses that are reasonably foreseeable and arise directly from our breach of these Terms or our legal obligations.

If you are a consumer, nothing in these Terms is intended to give you fewer rights than you have under applicable UK law.

SECTION 17 - EVENTS OUTSIDE OUR CONTROL

We will not be responsible for delay or failure to perform our obligations where the delay or failure results from circumstances outside our reasonable control.

Examples may include:

  • natural disasters;

  • severe weather;

  • war or civil unrest;

  • strikes or industrial disputes;

  • government action or restrictions;

  • major transport disruption;

  • serious technical failures;

  • interruptions to telecommunications or internet services; or

  • significant disruption affecting our suppliers or fulfilment providers.

This section does not remove any statutory rights you may have.
